This is a public interest case instituted by Olisa Agbakoba SAN. The suit challenges the constitutionality of the allocation of revenue from the Federation account to ‘interim committees’, ‘transition committees’, ‘caretaker committees’ etc. It is predicated on the provisions of Section 7(1), and Section 163(3) of CFRN 1999.

This suit was commenced against the Defendants, The Attorney General of The Federation; The National Judicial Council; The National Assembly by Originating summons. The Plaintiff contends that Section 81(1)(2) CFRN 1999 excludes the remuneration, salaries and allowances and recurrent expenditures of the Judiciary from the President's Appropriation Bill being Charges upon the Consolidated Revenue Fund of the Federation. Section 81(3)(C) CFRN 1999 also guarantees direct payment to the NJC of any amount standing to the credit of the Judiciary in the Consolidated Revenue Fund of the Federatio.

The Plaintiff filed this suit against the Defendants, the Attorney General of Ekiti State; Ekiti State House of Assembly; Chief Judge of Ekiti State; President Ekiti State Customary Court of Appeal to challenge the propriety of the urrent source of funding of the Judiciary in Ekiti State. The suit is brought pursuant to Section 1 (1) & Section 121(3) Constitution of The Federal Republic of Nigeria 1999. The objective is to secure independent funding for the Judiciary, free from executive interference and control.
